【摘要】 当前,我国旅游业高速发展,旅游资源的开发利用强度也不断加大。随之而来,旅游资源自身遭到破坏,也造成了严重的环境破坏和污染。在贯彻落实科学发展观,构建法治社会、和谐社会的现实背景下,我们应当更加重视旅游资源的法律保护。全文除前言和结语外,共分为四个部分:第一部分总结研究我国旅游业发展的特点和趋势,界定旅游资源的概念、特点和旅游资源资产的特点,分析旅游资源开发的必要性和开发对旅游资源保护提出的挑战。第二部分阐述旅游资源保护的必要性,并对旅游资源保护的理论基础进行梳理。第三部分分析我国旅游资源法律保护的现状及其存在问题。我国旅游资源法律保护主要存在四方面问题:第一,我国现有的旅游资源产权制度违背了公平和效率的要求。第二,旅游资源保护立法滞后。第三,旅游资源保护行政执法不力。第四,旅游资源保护司法工作薄弱。第四部分提出强化我国旅游资源法律保护的对策。第一,要确立可持续发展与利用、利益协调统一和权利义务相一致的基本原则。第二,科学界定旅游资源产权关系,积极引入旅游产业市场化机制。第三,完善旅游资源保护立法;加强旅游资源保护的行政执法,完善执法监督;优化旅游资源保护的司法配置,积极开展司法建议工作;加强法制宣传教育,提高全民旅游资源保护意识。
代写硕士论文【Abstract】 At present, the tourism in our country is developing at breakneck speed, the intensity of the exploitation of tourism resources is also increases. In the train of the situation, the tourism resources are being destroyed, and have also caused serious damage and pollution to the ecological environment. In the realistic background of the implementation of scientific perspectives, the establishment of the rule of law society and harmony society, we should pay more attention to the laws to protect tourism resources.In addition to the preface and conclusion, the article were divided into four parts:In the first part, it is the summary of the characteristic and tendency of the tourism and defines the concept and the characteristics of the tourism and tourism resources assets, and analyzes the necessity of the tourism resources exploitation and the challenges in the course of exploitation.The second part, it illustrates the necessity of the protection of tourism resources and combs out the theoretical basis of the tourism resources protectionThe third section analyzes the present situation and the problems of the laws to protect tourism resources. There are four key problems :First, Our existing resources in tourism in the property against the demand of fairness and efficiency. Second, the tourism resource protection legislation lags behind. Third, the administrative law enforcement is ineffective. Fourth, the judiciary lags behind.The fourth part puts forwards the legal countermeasures of tourism resources protection. First, we should establish the basic principles of sustainable development and coordination and interests of uniformity and rights and obligations .Second, we should have a definite relation between property and tourism resources in tourism industry and introduces the market-oriented mechanism. Third, we should perfect the tourism resource protection legislation to protect tourism resources, strengthen the administrative law enforcement and improve law enforcement and judicial, optimize the allocation and effective judicial proposal, strengthen legal education and increase the consciousness of tourism resources protection.
